Chapter 7 Bankruptcy

When you file Chapter 7 bankruptcy, you say “Sorry, I have these debts I just can’t pay.” Credit cards, medical bills, car repossessions, personal loans—Chapter 7 bankruptcy discharges (clears) them.

If you have car payments, you need to keep paying if you want to keep the car. And you need to keep making your house payment—or rent—if you want a place to stay.

Chapter 7 does NOT help you with child support or alimony. It does discharge taxes more than three years old, if filed on time. It doesn’t help with new taxes, or taxes you forgot to file.

Three out of four personal bankruptcies in Northern Virginia are Chapter 7. When you and I have our Zoom consultations, we’ll look first at whether Chapter 7 is right for you.

Chapter 13

Chapter 13 is a court-approved plan to pay some or all your debts.

We look at Chapter 13 if there’s a special reason Chapter 7 won’t work for you.
